1. About GoVia

The GoVia website and mobile application ("Platform") are owned and operated by MASTERMINDNEO TECHNOLOGIES PRIVATE LIMITED, a company incorporated under the Companies Act, 2013 bearing CIN U62011PN2026PTC255681.

GoVia is a technology platform that enables users to connect with one another for ride-sharing and parcel-pooling opportunities.

GoVia does not own, operate, manage, control, or provide transportation, courier, logistics, delivery, passenger transport, or shipping services.

GoVia acts solely as an intermediary platform facilitating communication and bookings between users.

2. Eligibility

  • You must be at least 18 years of age.
  • You must provide accurate and complete information.
  • You must comply with applicable laws and regulations.
  • You are responsible for all activity under your account.

3. User Responsibilities

Users agree to:

  • Provide truthful information.
  • Use the platform lawfully.
  • Treat other users respectfully.
  • Follow traffic and safety laws.
  • Ensure parcels are lawful and safe.

Users must not:

  • Engage in fraudulent activity.
  • Carry prohibited or illegal goods.
  • Transport hazardous materials.
  • Misrepresent identity or trip information.
  • Use the platform for unlawful activities.
  • Harass, threaten, or harm other users.

4. Independent Users

Drivers, travelers, senders, and receivers are independent users of the platform.

They are not employees, contractors, agents, representatives, partners, or affiliates of GoVia.

GoVia does not supervise, direct, control, or manage user activities.

5. Nature of Services

  • GoVia is not a transportation provider.
  • GoVia is not a courier company.
  • GoVia is not a logistics company.
  • GoVia is not a shipping company.
  • GoVia does not employ drivers.
  • GoVia does not employ delivery personnel.
  • GoVia does not take possession of parcels.

Any ride, parcel exchange, transportation, or delivery activity occurs directly between users at their own discretion and risk.

Carpooling and Cost-Sharing Basis

GoVia operates as a private carpooling and cost-sharing facilitation platform, not a commercial passenger transport or ride-hailing aggregator service. Drivers using GoVia are independent individuals sharing journeys they are independently undertaking for their own purposes, and are not engaged by GoVia to provide transportation as a commercial service.

Amounts exchanged between a driver and a co-traveler through the platform are limited to a reasonable contribution towards the driver's actual fuel, toll, and vehicle-running costs for the shared journey, calculated within limits set by GoVia from time to time. This arrangement is not intended to, and must not, generate profit for the driver beyond such cost recovery.

GoVia's Fee

GoVia charges users a separate, fixed platform fee for enabling contact details and trip coordination between matched users. This fee is charged for the use of GoVia's matching and communication service, is not calculated as a percentage or share of the cost-sharing amount exchanged between users, and does not constitute a commission on the driver's journey costs.

Usage Limits

To preserve the private, non-commercial nature of this arrangement, GoVia may limit how frequently any individual may offer trips through the platform within a given day, week, or month. These limits are set and updated by GoVia from time to time and are displayed within the platform.

6. No Guarantee of Service

GoVia does not guarantee:

  • A ride will be completed.
  • A parcel will be delivered.
  • A booking request will be accepted.
  • A user will fulfill any commitment.

7. Bookings & Payments

  • Payments may be processed through third-party providers.
  • Platform fees may be charged.
  • Bookings are confirmed only after successful payment.
  • Payment providers operate independently from GoVia.

GoVia is not responsible for failures caused by banks, UPI networks, card networks, payment gateways, or technical issues outside its control.

8. Platform Fees & Refunds

Refund eligibility may vary depending on booking type, cancellation timing, payment method, and promotional offers.

Platform fees, payment gateway charges, taxes, and similar fees may be non-refundable where permitted by law.

Refund processing timelines depend on payment providers and banking systems.

9. Parcel Pooling

Users are solely responsible for parcel contents, packaging, declarations, and compliance with applicable laws.

GoVia does not inspect, verify, store, transport, insure, or take possession of parcels.

10. Prohibited Items

  • Weapons or ammunition.
  • Explosives or hazardous materials.
  • Illegal drugs or narcotics.
  • Counterfeit goods.
  • Cash, precious metals, or valuables.
  • Restricted items prohibited by law.

11. Safety

Users are responsible for their own safety decisions.

GoVia may provide safety-related features including:

  • Profile information.
  • Verification indicators.
  • Emergency tools.
  • Location sharing features.

These features are provided for convenience and do not constitute guarantees regarding identity, conduct, safety, reliability, or suitability of any user.

12. No Insurance

GoVia does not provide transportation insurance, parcel insurance, cargo insurance, liability insurance, or personal accident insurance.

13. User Content

Users may submit reviews, ratings, photos, messages, and other content.

By submitting content, users grant GoVia a non-exclusive license to use, process, display, and store such content.

14. Limitation of Liability

To the maximum extent permitted by law, GoVia shall not be liable for accidents, injuries, death, property damage, parcel loss, delays, missed trips, fraud, disputes, or user conduct.

15. Indemnification

Users agree to indemnify and hold harmless GoVia, its founders, directors, employees, affiliates, and partners from claims, losses, damages, liabilities, penalties, and expenses arising from platform use.

16. Platform Availability

GoVia does not guarantee uninterrupted platform availability. Features may be modified, restricted, suspended, or discontinued at any time.

17. Force Majeure

GoVia shall not be liable for delays, interruptions, failures, or damages resulting from events beyond its reasonable control, including:

  • Natural disasters.
  • Floods.
  • Strikes.
  • Government actions.
  • Internet outages.
  • Payment provider failures.
  • Power failures.

18. Suspension & Termination

GoVia may suspend, restrict, or terminate accounts for fraud, abuse, safety concerns, legal compliance, or violations of these Terms.

19. Governing Law

These Terms shall be governed by the laws of India.

Any disputes shall be subject to the exclusive jurisdiction of the courts located in Pune, Maharashtra, India.
